1. Definitions

In these Terms, the following words carry the meanings set out below:

"We / Us / Our / Naga Advocates"
Naga Advocates, a legal advocacy practice registered and operating in Thailand, with offices at 207 Ratchaprarop Road, Ratchathewi, Bangkok 10400.
"You / Client"
The individual or entity who contacts us or engages our services.
"Services"
The pension advocacy, review, response support, and related advisory work we provide as described on our website and in any engagement letter.
"Agreement"
These Terms together with any written engagement letter or service confirmation we issue to you.
"Website"
Our website available at nagaadvo.club.

2. Acceptance of Terms

By submitting an enquiry through our website, contacting us by phone or email, or signing an engagement letter, you confirm that you have read, understood, and agree to these Terms.

You confirm that you are at least 18 years of age and have the legal capacity to enter into this agreement. If you are acting on behalf of another person, you confirm that you have the authority to do so.

3. Our Services

Naga Advocates provides pension advocacy services to clients in Thailand. Our current service offerings are:

  • Pension Standing Review — ฿7,200

    A careful review of your pension matter, gathering relevant documents and explaining them in plain terms.

  • Formal Response Support — ฿10,900

    Considered assistance preparing formal responses and appeals where a pension decision appears to be in error.

  • Comprehensive Protection Service — ฿13,700

    Full, sustained support for complex or long-running matters requiring formal steps, submissions, and continuing advice.

The scope of any specific engagement will be set out in a written service confirmation or engagement letter. Service availability may be subject to our capacity and the circumstances of your matter.

4. Engagement Process

An engagement begins when we issue a written service confirmation or engagement letter and you confirm your agreement to proceed. Before that point, any conversation or correspondence is preliminary and does not create a binding service obligation on either side.

We will explain the proposed scope, timescales, and fees before asking you to confirm. You are under no pressure to proceed and may take time to consider at your own pace.

5. Client Responsibilities

To allow us to assist you properly, we ask that you:

  • Provide accurate and complete information relevant to your pension matter.
  • Inform us promptly of any changes in circumstances that may affect your matter.
  • Respond to our requests for documents or instructions within a reasonable time.
  • Use our website and services only for lawful and legitimate purposes.
  • Not misrepresent your identity or the nature of your matter.

We reserve the right to pause or withdraw from a matter if provided information proves materially misleading or if the engagement falls outside the scope agreed.

6. Fees & Payment

Fees are as stated on our website and in your engagement letter. All fees are quoted in Thai Baht (฿) and are inclusive of applicable taxes unless stated otherwise.

Payment terms will be set out in the engagement letter. Fees for initial review services are typically payable before work commences. For longer engagements, staged payments may be agreed.

We accept bank transfer and payment methods confirmed at the time of engagement. Please retain your payment confirmation as evidence of settlement.

Refunds: Where a service has not yet commenced following full payment, a refund of fees paid may be requested. Once substantive work has begun, fees reflect work already carried out and refunds will be considered on a case-by-case basis with reference to the portion of work completed. We will discuss any concerns openly and without pressure.

7. Intellectual Property

All content on our website — including text, layout, and design — is the property of Naga Advocates or its licensors. You may not reproduce, redistribute, or use it commercially without our written permission.

Documents, letters, and materials we prepare on your behalf as part of your engagement may be used by you for the purpose for which they were prepared. Broader reproduction or publication is not permitted without our agreement.

8. Confidentiality

We treat all information you share with us in connection with your matter as confidential. We will not disclose it to third parties except as required to carry out your instructions, as permitted by law, or as necessary to comply with a legal obligation.

We ask that you also treat any advice, strategy, or materials we provide as confidential and not share them with parties adverse to your interest.

9. Disclaimers

Our services are provided to support your understanding and navigation of pension matters. We do not offer any assurance of a particular outcome. Pension decisions rest ultimately with the relevant authority, and the result of any formal process depends on the facts and the applicable rules at the time.

Information on our website is provided for general reference only and does not constitute legal advice. We recommend seeking specific advice from us or from a qualified legal professional before acting on anything found here.

Our website is provided "as is" without any representations or warranties as to its accuracy, completeness, or continued availability.

10. Limitation of Liability

To the extent permitted by Thai law, our total liability to you in connection with any engagement shall not exceed the total fees paid by you for the specific service in question.

We shall not be liable for: loss of income; indirect or consequential losses; losses arising from reliance on general website content; or circumstances beyond our reasonable control (including delays by pension authorities or third parties).

Nothing in these Terms limits liability for fraud, death, or personal injury caused by our negligence.

11. Indemnification

You agree to indemnify Naga Advocates against any claims, losses, or costs (including reasonable legal costs) arising from your breach of these Terms, any inaccuracy in information you provided, or your misuse of our services or website.

12. Termination

Either party may bring an engagement to a close by giving written notice to the other. If you wish to end an engagement, please write to us at [email protected].

We may withdraw from an engagement — with reasonable notice — if: we are no longer able to act for professional reasons; you have not provided necessary information or instructions; fees remain unpaid after reasonable notice; or the matter falls outside the agreed scope.

Sections 7, 8, 10, and 13 survive the end of any engagement.

13. Dispute Resolution

These Terms are governed by the laws of the Kingdom of Thailand. Any dispute will be subject to the jurisdiction of the Thai courts.

Before resorting to formal proceedings, we ask that any concern be raised with us directly in writing. We will respond within 14 working days and will try in good faith to reach a reasonable resolution. We may also consider mediation if both parties agree.

14. General Provisions

  • Entire Agreement: These Terms, together with any engagement letter, form the full agreement between us and replace any prior discussions or correspondence on the same subject.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
  • Waiver: Our failure to enforce any right under these Terms is not a waiver of that right.
  • Assignment: You may not assign your rights under these Terms without our prior written consent.
  • Notices: Written notices may be delivered by email to the address on file or by post to our Bangkok office.

15. Changes to These Terms

We may update these Terms from time to time. The current version will always be available on our website with the effective date shown above. For clients in an active engagement, we will give reasonable notice of any material change.

Continued use of our website or services after any update constitutes acceptance of the revised Terms.
